SIGNAL PRIVACY INVESTIGATORS NEEDED
INTRODUCTION:
During the 2005 Fight Season, between the hours of 9 PM and 1 AM Eastern Daylight Savings Time, our client, will be promoting a series of major Sporting Events (Championship fights, soccer, etc.) on Pay-Per-View (HBO, Showtime, etc.). Of special note, fight aficionados advised this office that these are the MAJOR FIGHTS OF 2005. It is anticipated that at $59 per household, each fight will be sold out to almost 52% of the DirecTV households (30-million) in the USA; and as a result, another 18 to 20% of the population will view these fights at BARS, CASINOS, RESTAURANTS, SPORTS BARS & CLUBS, GENTLEMENS CLUBS, BODEGAS, MERCADOS, TACQUERIAS, etc. Most places where people will be viewing the event will be legal. You will be given the LEGAL list in the late morning the day before the event. However, there is no fine line of distinction for the viewing public, whether the establishment is LEGAL or a PIRATE. There are a large number of sports and fight enthusiasts, given the value of each particular sporting event, who will be searching for a location to view the event. Economically, major sporting events are a boom to establishment operators who profit from drink sales, cover charges, food sales and a repeat business. This means that there are going to be lots of scrupulous establishment operators who will desire to take advantage of the system. They steal or pirate cable or satellite pay per view events and attract customers. What this means is that they are STEALING business from our client and our clients customers who pay $3,000 to $10,000 to have the LEGAL rights to screen these program to customers. The pirates are stealing the event at residential rates of $59 or as little as $35 for a satellite card. Under 47 U.S.C. Sections 553/605 this is a violation of Federal Statutes. When prosecuted, the pirate establishments are looking at fines in excess of $110,000 and statutory judgments, court costs and legal fees, possible loss of business license (in some jurisdictions). So, you see now this is a VERY SERIOUS BUSINESS. Please note. When you investigate these events, you are representing the promoter’s interest, as well as your own local community establishment owners. They are making a major investment upward of $3,000 to have the legal right to screen these events in their bars, clubs, casinos, restaurants, coffee shops, retail stores, etc. When the marketing and sales department of HBO, SHOWTIME and the PROMOTERS sell these events to the establishment owners, the biggest obstacle is the buyers FEAR of the pirate across the street or down the block in your community who steals both the event and the customers and income potential of the buying legal owner of the rights to screen the event. It is your mission, to protect that investment. When you receive the LEGAL list from our office, wherever you provide your services, your first mission is to contact the LEGAL customer (bartender, manager, etc.) to introduce yourself as the investigative agency on behalf of the Sporting Event fight promoter/s, HBO, Showtime, and Pay Per View. Reiterate to that party you contact that your job is to protect their investment by identifying the pirates in your community who may be stealing the event or their customers and potential income. Obtain from them (and they know who is stealing from them) a list of all of the possible competitors that they or their staff might know as pirates who are stealing this or past events and your team will investigate on their behalf to stop piracy. Because these events are typically sold in major markets or population centers, the establishments in smaller markets are stealing it. That takes your ingenuity and investigative smarts to cull out the pirates if you are in a smaller market.
TO ALL INVESTIGATORS:
It's very important that you utilize your investigative time properly (15-20 mins. per location), to be cost effective. If you are able to verify, when entering an establishment, that in fact the TV monitors are indeed tuned into HBO, Showtime, etc. from 9:00 PM till 1:00 AM Eastern Daylight Time, it is then important for you to gather the affidavit details of the pirating establishment. You MUST be able to verify what ROUND, and what you SAW on the TV monitor for each establishment you hit, in order to gather proper evidence for litigation purposes, as well as to complete your assignment. You DO NOT have to wait until the main event to prove the case. If you gathered sufficient detail data (discovery of piracy) at the above time periods, and the TV or wide screen or plasma TV is screening the event, or any of the UNDER CARD FIGHTS, you have then gathered sufficient data for the Affidavit and you can move on to the next establishment. DO NOT FORGET TO DESCRIBE THE ESTABLISHMENT, AND GET WITNESS DATA FROM AUTO LICENSE PLATES, WHERE AVAILABLE UPON LEAVING. TAKE TWO (2) PHOTOS OF THE OUTSIDE AND VIDEO OF THE INSIDE, IF YOU CAN SAFELY OBTAIN THEM. THE TWO (2) PHOTOS OF THE OUTSIDE MAY BE TAKEN AFTER HOURS OR THE NEXT DAY.
SAMPLE CASE#1 SUPPLED BY CLIENT
As simple as it sounds, this is BASIC INVESTIGATION WORK. But, it must be conducted wisely. An example is a new investigator who took on the Jones-Tarver broadcast on Pay Per View as their first-ever test. Monday morning I got faxes of 14 positive verifications of signal piracy from this new St. Louis investigator who fielded 4-investigators. On Friday, as soon as the St. Louis team got a hold of our FAX listing of approved legally licensed locations, they put two in-office secretaries to work to scout out sports bars, clubs, pubs, restaurants and bodegas in or around Greater St. Louis. First they called the legal list to obtain suspect referrals of known pirates. They followed the successful guidelines given them, the same guidelines listed above. Then they got busy doing some cold calling research on Saturday. A simple script was hi; my husband wants to bring some of his friends from work to your bar. He asked me to call to find out if you were going to have the Jones-Tarver fight on your TV tonight? We don’t get HBO Pay-Per-View at home! Do we need to reserve, or can they just show up. In some cases, they later learned that the proprietor, waitress or bartender lied, to get the group to come to the bar, where they did not have the fight on. But in most cases of the 27 or 28 calls made, 14 were positive HITS between the legal list referrals and the cold calling done as a follow up.
SAMPLE CASE#2 SUPPLED BY CLIENT
A newly associated PI firm in Georgia got one hit. The principal owner of the PI firm was skeptical and did not want to put his PI’s in the field unless he knew for certain that the system worked. He went out himself, cold calling on a popular sports bar in his own neighborhood near Buckshead (Atlanta area). He walked in around 10:20 and saw that over 18 TV monitors had various sports events running but none were HBO Pay-Per-View Boxing. So, he determined, it isn’t here, per his own words. He downed one more beer and all of a sudden the large plasma screen monitor was switched to HBO BOXING and BANG!!! It was the preliminary undercard fight. He remained until the second round of the main event, and while calling his wife, he took photos with his cell phone, then recorded the bar and parking lot license plates and completed the affidavit which he faxed Sunday morning to our office along with the e-mail of the cell phone digital photos. This weekend he plans to field four places for the Chavez vs. Randall fight. We want you to get as many establishments as you can, per field investigator or auditor; however, you must have details.
YOU MUST DEVELOP TECHNIQUE AND FOLLOW THE SAME PRINCIPALS OF SIMPLE AND BASIC INVESTIGATING.
Location and timing and knowledge are all very important determinations in the field of success. Read and understand the affidavit to know what we require out in the field on our reports. Efficiency is vital in this industry, especially given the cost of time and gas. COMPENSATION:
ASISS client will compensate you $100.00 per notarized affidavit, to include two (2) site photographs of the outside; or, $125.00 per notarized affidavit with two (2) site photographs of the outside plus a video VHS or Digital format of the inside. The photographs should include two (2) pictures of the front of the location that shows the name of the establishment and possibly the address number of the location (per affidavit) as well as a side view which shows apartments, a parking lot, or satellite dish. The video should show the television, which is broadcasting the event as well as the bartender or other employees. Should you be required to pay a cover charge upon entrance of the establishment, be sure to obtain a receipt or ticket stub to be submitted with your affidavit. This expense, and only this expense, will be reimbursed if the location is a violator. We will pay all within thirty (30) days of the submission with the condition that the locations reported are not on the legal list that you were provided prior to the event, and that the affidavits are completed in full, notarized and submitted within three (3) days of the event. The aforementioned fees include, but are not limited to, the preparation of an acceptable affidavit, as well as any additional auditor certification or other assistance that may be requested by the attorney representing the promoter of the event.
IT IS VITALLY IMPORTANT THAT YOU FAX A COPY OF THE AFFIDVIT TO: (718-823-8448), EVEN IF YOU DO NOT HAVE IT NOTARIZED. I MUST RECEIVE THAT FAX NOTIFICATION WITHIN 24 HOURS AFTER THE VISUAL YOU MAKE. YOU MAY THEN SUBMIT THE NOTARIZED AFFIDAVIT, ALONG WITH YOUR PHOTOS AND YOUR VIDEOS WITHIN THREE (3) DAYS TO BE PAID. ALL AFFIDAVITS MUST BE ON OUR FORM AS PROVIDED TO YOU! ************************************************************* Although it is not likely that the client will go to trial with an establishment that is a violator of this event, it is not impossible. If an investigator is needed for litigation purposes (i.e.: depositions, discovery procedures, etc.) by the clients legal firm you will be paid an additional $25.00 per hour plus associated travel costs for his/her testimony.
